General terms of application
1. Content.
Certain parts of the Art Market Platform allow you to provide comments, text, photos, information and other content. By providing Content, in any form and by any means whatsoever, you grant Art market, from the moment you create or publish this Content and for the duration of the protection of the rights assigned, a non-exclusive, worldwide license , royalty-free, sublicensable, and transferable, to access, use, store, reproduce, modify, create derivative works of, distribute, publish, transmit, broadcast, and otherwise exploit this Member Content in order to provide and/or promote the Art market platform on any medium, known or not yet known to date and in particular on the Internet and on social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. You are solely responsible for all Content that you provide and warrant that you own it or are authorized to grant Artmarket the rights described in these Terms. You are responsible if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with international rules, which prohibit, among other things, discriminatory, obscene, harassing, misleading, violent and illegal content. You agree that Art market may make available automated services or tools to translate Content and that your Content may be translated using such services or tools.
2. Fees.
Art market may charge Sellers fees for using the Art market platform. To learn more about applicable service fees and how they are calculated, see our Service Fees page. Unless otherwise stated on the Art market platform, service fees are non-refundable. Art market reserves the right to change the service fees at any time, and will notify Members of any fee changes before they become effective.
3. Rules of the Art market platform.
3.1 Rules.
You must abide by these Rules and must not aid or encourage others to break or circumvent them.
• Act with integrity and treat others with respect
– Do not lie, misrepresent something or someone, or pretend to be someone else.
– Be polite and respectful when communicating or interacting with others.
• Do not damage, hack, reverse engineer, compromise or alter the Art market platform
Not to use robots, crawlers, scrapers or other automated means to access or retrieve data or other Content on or to interact with the Art market platform.
– Not hack, circumvent, remove, alter or attempt to circumvent any security or technological measure used to protect the Art market platform or content.
– Do not decipher, decompile, disassemble or reverse engineer any software or hardware used to provide the Art market platform.
– Not to take any action that could disrupt or harm the performance or proper functioning of the Art market platform.
• Not to use the Art market platform outside the framework of these Conditions or any other contract established with Art market
– You may only use another Member’s personal information to the extent necessary to facilitate a transaction using the Art Market Platform, as permitted by these Terms.
– Not to use the Art market platform, our messaging tools or Members’ personal information to send commercial messages without the express consent of the recipient.
– Use the Content made available by the Art market platform only if this is necessary to enable you to use the Art market platform as a seller or buyer.
– Do not use the Content unless you have permission from the owner of the Content or the use is authorized by us under these terms or in another contract you have entered into with Art market.
– Do not request, make or accept a sale or a Payment outside the Art market Platform.
– Do not require or encourage buyers to open an account, leave a review or otherwise interact with any third-party website, application or service before, during or after a sale, unless authorized by Art market.
– Not to use, copy, display or frame the Art market platform, any Content, any Art market marks, or any layout or design without our consent.
• Comply with your legal obligations
– Understand and follow the laws that apply to you, including privacy, data protection and export laws.
– If you provide us with another person’s personal information: (i) you must do so in accordance with applicable law, (ii) you must be authorized to do so, and (iii) you authorize us to process that information under our Privacy Policy.
– Do not use Art market or others name, logo, brand or trademarks without permission.
– Do not use or register any domain name, social media ID, trade name, trademark, logo or any other source identifier that could be confused with the Art market brand.
– Not offer Services that violate laws or contracts that apply to you.
3.2 Copyright Notices.
If you believe that any Content on the Art Market Platform infringes copyright, please notify us in accordance with our Copyright Policy.
4. Termination, Suspension and Other Actions.
4.1 Duration.
The contract between you and Art market reflected in these Terms remains in effect until you or we terminate the contract in accordance with these Terms.
4.2 Offenses Committed by a Member.
If (i) you violate these Terms, our Policies or our Standards, if (ii) you violate applicable laws, regulations or the rights of third parties, if (iii) you have repeatedly received bad feedback or if Art market becomes aware of or has received complaints regarding your performance or conduct, if (iv) you have repeatedly canceled confirmed purchases, action is necessary to protect the personal safety or property of Artmarket, its Members or third parties, Art market can:
• suspend or limit your access to the Art market platform and/or your account, or its use;
• suspend or remove Ads, comments or other Content;
• cancel purchases in progress or confirmed; Or
• suspend or revoke any special status associated with your account.
In the event of minor violations or where applicable, you will be notified of any action Art market is considering and given an opportunity to remedy the problem, unless such notification (i) would avoid or prevent the detection or prevention of the fraud or other illegal activities involved, (ii) would harm the legitimate interests of other Members or third parties, or (iii) would violate applicable laws.
4.3 Legal mandates.
Art market may take any measure it considers reasonably necessary to comply with the applicable law, or with a decision of a court, or with any other judicial, administrative or police authority duly empowered.
- Modification of these Terms.
suspend or limit your access to the art market platform and/or your account, or its use; • suspend or delete Ads, Comments or other Content; • cancel current or confirmed purchases; or • suspend or revoke any special status associated with your account. In the event of minor infringements or where applicable, you will be informed of any action envisaged by the art market and you will have the opportunity to remedy the problem, unless such notification (i) prevents or avoids the detection or prevention of fraud or other illegal acts. activities involved, (ii) harm the legitimate interests of other Members or third parties, or (iii) violate applicable laws.
- Member Accounts.
You must create an account to access and use many features of the Art Market platform. Registration is only permitted for legal persons and natural persons aged 18 or over. You represent and warrant that you are not a person or entity prohibited from using the Art market platform. You must provide accurate and complete information when registering, and keep your account information up to date. You cannot create more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account identifiers, and you are prohibited from disclosing your identifiers to any third party. You must immediately notify Art Market if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. You are responsible for all suitable activities with your Art Market account, unless you have not authorized these activities and have not otherwise been negligent. If permitted by applicable law, we may, but are under no obligation to (i) require you to provide identification or other information, (ii) undertake verifications to help verify your identity or history, (iii) compare yourself to third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender files or their local counterparts.
7.Additional distribution channels.
Art Market offers an affiliate program that allows Ads to be displayed on third-party websites, media, loyalty programs. Advertisements may also appear in advertisements for Art Market sometimes published on third-party websites.
